1. GENERAL PROVISIONS

1.2 Scope and Acceptance

These Terms and Conditions (“Terms”) govern all bookings, purchases, and services provided through www.sorrentoluxury.net. By placing an order or making a booking, you (“Customer” or “you”) agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our services or make any purchases.

1.3 Services Offered

We offer luxury boat tours, yacht charters, excursions, and related services in Sorrento, Capri, Amalfi Coast, and surrounding areas. Services include:

  • Private and shared boat tours
  • Yacht charters with professional crew
  • Day trips and sunset experiences
  • Sea transfers and high-speed charters
  • Additional services (catering, photography, special occasions)

All services are subject to availability and weather conditions.

2. BOOKING AND PAYMENT

2.1 Booking Process

To make a booking:

  • Select the desired service, date, and options
  • Provide accurate personal and contact information
  • Review the booking summary and total price
  • Complete payment through our secure payment system
  • Receive booking confirmation via email

A booking is considered confirmed only upon receipt of full payment and issuance of a confirmation email from Sorrento Luxury.

2.2 Prices

All prices are displayed in Euros (€) and include:

  • Applicable VAT (Value Added Tax) as required by Italian law
  • Basic service as described in the booking

Prices do not include:

  • Optional extras (unless specifically selected)
  • Entrance fees to attractions (e.g., Blue Grotto in Capri)
  • Food and beverages (unless included in package)
  • Gratuities for crew (optional but appreciated)

We reserve the right to modify prices at any time. However, the price confirmed in your booking confirmation email will be honored.

2.3 Payment Methods

We accept the following payment methods:

  • Bank transfer / Wire transfer (advance payment required)
  • Credit/Debit cards (via Nexi secure payment gateway)
  • PayPal
  • Apple Pay
  • Google Pay

Payment processing is handled securely by certified payment providers. We do not store your credit card information on our servers.

2.4 Payment Terms

  • Full payment: required at the time of booking for most services
  • Deposit option: for certain high-value bookings, a 50% deposit may be accepted, with the balance due 7 days before the service date
  • Late payment: failure to pay the balance by the due date may result in automatic cancellation with forfeiture of the deposit

Bank transfer details will be provided in the booking confirmation email.

3. CANCELLATION AND REFUND POLICY

3.1 Cancellation by Customer

Cancellations must be submitted in writing via email to info@sorrentoluxury.it. The following refund policy applies:

  • More than 14 days before service date: Full refund minus 10% administrative fee
  • 7-14 days before service date: 50% refund
  • Less than 7 days before service date: No refund
  • No-show: No refund

Refunds will be processed within 14 business days to the original payment method.

3.2 Modification by Customer

You may request to modify your booking (change date, service, or guest count) subject to availability:

  • More than 7 days before: Free modification (subject to availability and price differences)
  • Less than 7 days before: Modification fee may apply; contact us for details

All modification requests must be made in writing and are subject to our confirmation.

3.3 Cancellation by Sorrento Luxury

We reserve the right to cancel or reschedule services due to:

  • Adverse weather conditions (safety first policy)
  • Technical or mechanical issues with vessels
  • Force majeure events (natural disasters, strikes, government restrictions)
  • Port authority restrictions

In case of cancellation by us, you will receive:

  • Full refund of all payments made, OR
  • Rescheduling to an alternative date (subject to availability), OR
  • Credit voucher valid for 12 months

We are not liable for any additional costs incurred (e.g., accommodation, travel expenses) due to cancellations beyond our control.

4. RIGHT OF WITHDRAWAL (EU CONSUMERS)

Under EU Consumer Rights Directive 2011/83/EU and Italian Consumer Code (Legislative Decree 206/2005), consumers have the right to withdraw from distance contracts within 14 days.

IMPORTANT EXCEPTION: The right of withdrawal does NOT apply to bookings for services to be provided on a specific date or period (Article 59(1)(c) Consumer Code). This includes all our time-specific boat tours and excursions.

However, if you book our services more than 14 days in advance and no specific service date has been confirmed, you may exercise your right of withdrawal within 14 days of booking by sending written notice to info@sorrentoluxury.it.

For cancellations related to confirmed service dates, please refer to Section 3 (Cancellation and Refund Policy).

5. SERVICE EXECUTION AND CUSTOMER OBLIGATIONS

5.1 Meeting Point and Timing

  • You must arrive at the designated meeting point at least 15 minutes before departure time
  • Late arrivals may result in shortened tour duration or forfeiture without refund
  • Meeting point details will be provided in your confirmation email

5.2 Guest Conduct and Safety

All guests must:

  • Follow all safety instructions from the captain and crew
  • Wear life jackets when required
  • Not consume excessive alcohol or illegal substances
  • Treat crew, other guests, and vessels with respect
  • Supervise minors at all times
  • Disclose any health conditions that may affect participation (pregnancy, heart conditions, mobility issues)

We reserve the right to refuse service or disembark guests who violate safety rules or behave inappropriately, without refund.

5.3 Weather and Itinerary Changes

The captain has absolute authority to:

  • Modify routes for safety reasons
  • Skip certain stops due to sea conditions
  • Shorten or terminate tours for passenger safety

Minor itinerary changes due to weather or sea conditions do not entitle customers to refunds. Only complete cancellations by Sorrento Luxury qualify for refunds (see Section 3.3).

5.4 What to Bring

  • Valid photo ID (passport or ID card)
  • Sunscreen and sun protection
  • Comfortable clothing and non-slip footwear
  • Towels and swimwear (if planning to swim)
  • Medications (if needed)

6. LIABILITY AND INSURANCE

6.1 Our Liability

Sorrento Luxury S.R.L maintains comprehensive insurance coverage for its vessels and operations as required by Italian maritime law.

We are liable for damages caused by:

  • Negligence or willful misconduct by our crew
  • Defects in vessels or equipment that we knew or should have known about
  • Breach of our contractual obligations

We are NOT liable for:

  • Personal injuries caused by customer’s own negligence or failure to follow safety instructions
  • Loss or damage to personal belongings left unattended
  • Force majeure events (storms, earthquakes, strikes, government actions)
  • Third-party actions or services (e.g., Blue Grotto entrance operators, restaurants)
  • Seasickness or medical conditions
  • Indirect or consequential damages (lost profits, missed opportunities)

6.2 Limitation of Liability

To the maximum extent permitted by Italian law, our total liability for any claim shall not exceed the total amount paid by the customer for the specific booking in question.

This limitation does not apply to:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be limited by law

6.3 Customer’s Insurance

We strongly recommend that all customers obtain comprehensive travel insurance covering:

  • Trip cancellation and interruption
  • Medical expenses and emergency evacuation
  • Personal belongings and valuables
  • Personal liability

7. INTELLECTUAL PROPERTY

All content on www.sorrentoluxury.net, including text, images, logos, videos, and designs, is the property of Sorrento Luxury S.R.L or its licensors and is protected by Italian and international copyright laws.

You may not:

  • Reproduce, distribute, or modify website content without written permission
  • Use our trademarks, logos, or brand names for commercial purposes
  • Frame or link to our website in a misleading way

Photos taken during your tour are for personal use only. If you wish to use them commercially, please contact us for permission.

8. PRIVACY AND DATA PROTECTION

We process your personal data in accordance with EU Regulation 2016/679 (GDPR) and our Privacy Policy, available at www.sorrentoluxury.net/privacy-policy.

By making a booking, you consent to the processing of your personal data as necessary to fulfill the contract and provide our services.

9. DISPUTE RESOLUTION

9.1 Complaints

We will acknowledge your complaint within 48 hours and provide a substantive response within 14 days.

9.2 Alternative Dispute Resolution (EU Consumers)

If you are an EU consumer and cannot resolve a dispute with us directly, you may submit a complaint to the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr

9.3 Applicable Law and Jurisdiction

These Terms are governed by Italian law.

For consumers: Any dispute shall be subject to the exclusive jurisdiction of the court of the consumer’s place of residence (as per Italian Consumer Code).

For business customers: Any dispute shall be subject to the exclusive jurisdiction of the Court of Naples (Torre Annunziata), Italy.

10. MISCELLANEOUS

10.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Sorrento Luxury S.R.L regarding your use of our services.

10.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

10.4 Assignment

You may not transfer or assign your booking or these Terms to any third party without our written consent. We may assign our rights and obligations under these Terms to a third party.

10.5 Changes to Terms

We reserve the right to modify these Terms at any time. The updated version will be posted on our website with a revised “Last updated” date.

Changes will not affect bookings already confirmed. The Terms in effect at the time of your booking will apply to your purchase.
